A 22 year old in receipt of ESA and in the WRAG is living with parents. The parents move into a full service area. The 22 year old moves with them. The parents claim no benefits. My question is

does the 22 year old need to claim UC or does he stay on ESA?

as an added twist, if the parents need to claim UC the 22 year old becomes a non-dependent, would that make any difference to the need or not to claim?

Please note this is a hypothetical question as I try to get my head around all this.

As far as I am aware this would just be a change in circumstances for the non-dependent.  As long as his ESA remains in payment he just needs to report a change of address which is a change in circumstances.  No new claim to legacy benefit is needed so no new claim to UC.

If his parents had to claim UC - he would still remain on ESA as he has not had a CIC and therefore doesn’t need to claim another legacy benefit.  He would just be a non dep receiving ESA on his parents UC claim where a non dep charge would apply depending on the family circumstances.
