Hello,

I have a client who is due to have an oral hearing for her PIP.
As part of her disabilities, she suffers from memory loss. She struggles to remember back to when the original decision was made, therefore would struggle to answer the questions correctly at the hearing.

I am trying to think of ways for her to be able to give evidence without it looking both prompted and believable.

Can anyone help?

She could go through the PIP2 of which there will be a copy in the appeal papers.

Certainly in my experience if clients start saying anything different on the day (even when casting their minds back to the time before the decision was made) the tribunal will ask why this wasn’t put in the PIP2

Has there been any significant change to her conditions or their effects since the decision? If not….....

Tribunals themselves will often ask this as a way of facilitating the appellant giving evidence where some time haselapsed between the decision and the hearing.

Her mum believes that the condition has improved due to the children being at school during the day.
I will go with the PIP 2 form… See where that gets me.
