Disability reduction if disabled person leaves property

client with learning disability living with parents.  additional bathroom turned into wet room due to continence issues.  i assisted them to apply for disability reduction so band dropped.

client has now moved into own tenancy.

does the band reduction end with them leaving?

house still has been adapted for the needs of a disabled person and assuming the reduction is a form of compensation for that fact then is it arguable it should remain?

just wondering if anyone has had this before.

Hi, from memory the adaption has to be of importance to the wellbeing of the disabled person (at least here in England) so I wouldn’t have thought that this could apply when the person no longer lives there. This gov.uk page https://www.gov.uk/council-tax/discounts-for-disabled-people  states that:
“The property must be the main home of at least 1 disabled person.”

That said, I don’t know the Regs, maybe hkrishna can help again? http://www.rightsnet.org.uk/forums/viewthread/10870/
