Immigration appeal fee hike .. new regs

Blimey ....

New regs out today that (subject to exceptions) increase the fees payable for First-tier immigration appeals -

- from £80 to £490 where an appellant consents to an appeal being determined without a hearing,
- from £140 to £800 where the appellant does not consent to the appeal being determined without a hearing.

NB - accompanying explanatory memo also say that ‘the Government has decided to take forward the following increases which will move the fees charged in both the First-tier and Upper Tribunal to full cost recovery levels’ -

- introducing a fee of £455 for an application to the First-tier Tribunal for permission to appeal to the Upper Tribunal.
- introducing a fee of £350 for an application to the Upper Tribunal for permission to appeal in that Tribunal (where the application to the First-tier Tribunal has been refused); and
- introducing an appeal fee in the Upper Tribunal of £510.

The conventional attitude has always been that if fees were introduced, almost everyone would qualify for full fee remission so it would be pointless and cost the taxpayer to introduce any fees - there was a consultation on it at some point.

There was apparently a consultation on this one as well but it didn’t make any difference. Once we are no longer bound by the Humans Rights act, who knows what will follow!

Great stuff .....

... though noticed this at the end of the announcement

We will bring forward any new plans for Tribunal fees .... for consultation in due course.

The Government’s belief is unchanged that it is right that those who use our courts and tribunals should pay more, where they can realistically afford to do so, to ensure that the system is properly funded to protect access to justice and to relieve the burden on the taxpayer.

Watch that space?!
