Retaining worker status

Hi all,

I’m working an appeal today and want to reference a decision which I cannot for the life of me find or remember the citation for! I think it was a decision of Judge Jacobs which found (although this may not have been the main issue in the case) that there was nothing preventing an EU national from retaining worker status under one heading (such as a jobseeker) and then switching to retaining it under a different heading (such as temporary incapacity).

Anyone know the decision and can put me out of my misery!
