ES40 leaflet
I have a capital limits appeal for ESA, DWP papers refer to an ES40 Leaflet being sent out to client in Feb 2009 and “at various stages throughout your claim”.
Google turns up lots of references to an ES40 in connection with JSA, the New Deal and other stuff not related to ESA although I cannot find an actual ES40 form labelled as such.
Anyone got a copy of an ES40 leaflet or know what it is in relation to ESA?

DWP sub also says “you were entitled to a reduced or extinguished rate of ESA (IR) from [date] taking into account TI.
Anyone know what TI might be?

As its about overpayments, DWP probably referring to its instructions booklet/sheets about what to disclose - this is probably a version of what they are referring to if it helps.

Odd that DWP should only make such vague references to savings in this document, buried away on P.16 and P.17…
Another one on this…
Client was loaned approx. £5,000 by a friend to assist her with buying her Council house. The loan was specifically for that purpose and could not be used for anything else (verbal agreement which friend will back up). She initially enquired about buying it, her health deteriorated and she did not proceed. A couple of years later she enquired again but a survey report showed up some structural problems and she decided not to buy it after all. A few months later she returned the £5,000 to the friend.
What hope of arguing that this should be disregarded as her capital for the period she had it?
