Tenant moving from JSA to ESA. DWP not paying until HRT visit carried out..
She has a residents permitt with indefinite leave to remain..

they have refused to make interim payments and tenant has type1 diabetes, has had hypo due to no food etc…

if she has indefinite leave to remain from the borders agency, i don’t really understand how DWP could say she doesn’t have right to reside….

I’ve seen it happen (DWP insisting on applying RTR test where someone has ILR). The cases I’ve come across have usually been where the person orginates from Poland or one of the other former Soviet states but came to the UK prior to the state joining the EU (so was originally SIC). DWP frequently seem unable to grasp the concept.
