Income for Benefit purposes

Hi All

Wonder if someone could help me out with this. Client and partner are caring for their two grandchildren after the children’s parents were killed in a car crash. Client lives in England.

They are being paid by the Scottish court with the Grandad being a litigation friend for the children. The money is meant to cover the things the parents would have paid for such as holidays etc. They are receiving child benefit and child tax credit for four children (two of their own) and no other income.

The client was told these payments are income for benefits purposes and as such they are receiving no means tested benefits.

They receive payments of £12 000 per year for this.

The question is -  is the information about means tested benefits correct or can they claim housing benefit, ESA, JSA ?
