Hi all,

Just to flag up that we’ve got some new content on Ask CPAG Online, covering ESA Problem Areas

We’ve tried to cover a wide range of issues from claiming through conditionality and onto challenging decisions across the piece.

I’m sure there’s some gremlins lurking so please have a look and let us know your thoughts.

Excellent resource, Paul! I particularly like the piece giving advice on the assessment process. We have been trying to produce a similar guide for our tenants for some time, as many simply don’t have a clue what to expect. The number of people who think ESA is awarded on a list of diagnoses alone is frightening!

Paul - one area where we are experiencing increasing problems is post (successful) WCA hearings:

DWP claiming not to have received decision notice from HMCTS (despite normally being sent by email) and refuse to accept copy from claimant /rep.
Refusing to reinstate ESA (post MR or appeal) if claimant has award of JSA unless claimant ‘withdraws’ JSA claim.
Failure to include EDP if placed in support group.
Failure to pay arrears due for the correct period (inc ESA(IB) when claimants ESA(C) has already ended due to365 day rule).
