If one claimant is ill and claims ESA and their partner isn’t ill but not working, how does a joint ESA claim work?

Dealing with a client who told me her partner is ill and claiming ESA buts she is not on the claim. She only receives Child Tax credit, child benefit. A PIP application has just been put in for partner. Any advice appreciated.

If the partner is just claiming contributory ESA (which it sounds like if it is just for him) then he needs to be asked to assessed for income-related ESA - they will send out an ESA3 form - this will enable a top up of income-related ESA. If he is on income-related ESA already she should be included on the claim.
