Hi my client claims IS and has started working 10 hrs a week. She also claims carers. Today she has phoned DWP to inform them that her husband is now working 16 hrs a week so the claim needs to be closed and they will claim working tax credits.
They have been told they will not close the claim as they may still be entitled to IS
Is this correct?? I am brain dead today!!

Hi Carolyn - the partner of the IS claimant can work up to 24 hours - although their income may take them out of IS - see cpag pg 100 new book, pg 99 old book.

Though if they have children then WTC is also a possibility as you say

Thanks they are really wanting to come off IS as they are messing them about and leaving them without money. I will pass the info on.
