change of circs and former employer refusing to provide p45 or letter

I have a tenant who changed employment and notified HB of new earnings but his former employer refused to provide proof of final earnings, P45 etc.( we have threatened him with reporting to HMRC but he isn’t budging)

HB have assessed income on both jobs as they are arguing that tenant has to provide this proof…..

Can we request that the council contact the employer as I seem to have this in the back of my mind somewhere,
also can we request interim or payment on account?

Does the local authority have any real basis for concluding that he’s still doing both jobs.  What are the hours of the respective jobs?  Is it even feasible that he could be doing both?

What I’m building up to here is that there is nothing set down in law that says a claimant has to prove that they have stopped doing a job.  If they are both full-time jobs with similar hours then the Council is effectively alleging that your client has either cloned himself or perfected the art of astral projection.

Even if it’s feasible that he could be doing both jobs, is it really likely?  I am willing to bet that many local authorities do not require this proof (pretty sure mine doesn’t), and I am sure that there are plenty of employers who don’t do what they are supposed to when someone leaves their employment.

I have submitted an appeal putting the onus back on them stating reg 86(1) advising tenant tried all in his power to achieve the information and questioned their point that he was working 2 jobs at the same time…
