Non Dep deductions for under 25’s on ESA WRAG post April 2017

For HB I think there is a non-dep deduction for non-deps under 25 on the support component - always has been.  They only escape a deduction during the assessment phase when they are on the same rate of benefit as an under 25 JSA/IS claimant.  Once the higher personal allowance and component kicks in they do attract a deduction: that’s not changing.  The problem raised by the OP affects people in WRAG after the assessment phase ends: they stay on the same under-25 rate of ESA that applies during the assessment phase but a non-deduction is still taken.

I emailed .(JavaScript must be enabled to view this email address) to query this, don’t suppose they will take any notice of me but it does seem like an unintentional quirk arising from systematic consequential amendments: they have just done a find-and-replace job all through the HB Regs, whereas what Reg 74(8) requires is a more intelligent tailored amendment.

Thanks, HBA,  you’re quite right - not sure where that came from.

Re the initial issue I suspect you’re correct and was initially just unthinking cut-and-paste (rather than deliberate malice).

Any response to your query to minsters HBAnorak?
If I’ve followed the thread correctly, then the conclusion is that there will still be NDD of £14.80 for under 25s in the WRAG who have a WRAC of £0 following April changes, & the only under 25s who can get the £73.10 personal allowance in HB are those whose WRAC is payable at £29.05

As it stands I don’t think anyone except the support group gets the £73.10 personal allowance.

You wont be surprised to hear I didn’t get a personal reply from Damian Green, but I understand there is going to be an amendment to fix some unintended knock-on effects in HB ... a suggestion to include the non-dep issue in that amendment is being fed through the appropriate channels.
