Hello

Tenant is on JSA and HB and has 2 adult children living with him. Son (20 yo) is on UC and daughter 18 works p/t. Can’t get my head around what son pays, if anything.

No HCC for under 21s if claimant on UC.

In your case with claimant on HB and ND on UC then HB/CTB A8/2013 points out that:

6. Ministers have decided that non-dependants who are:
      aged under 25; and
      entitled to UC; and
      have no earned income
should not attract a non-dependent deduction.

Does this ‘exception’ from UC HCC for under 25’s still apply? Can’t find it anywhere?

Hi clive

I think that exception is where the claimant is on HB but the non-dependant is on UC. If the claimant is on UC then no HCC is applied only if the non-dep is under 21 as Gareth says

So the 21 to 24 year old non deps on £58 per week have to pay £16 towards rent when previously they would have been deemed too poor to contribute. In the sweep of a brush.

Three cases of this so far. Number of my UC cases have been middle former single parents found fit for work, so fairly common to have young non deps. Have made DHP applications.
