And for a derivative right to reside the education has to be compulsory education.  Nursery education doesn’t count although the ECJ in Shabani has left the door open for being in a reception class in a mainstream school to walk through, thanks to a concession made by the DWP in that case.

Even though the lone parent kept her worker status whilst claiming IS as a carer (as in Elmi) did she actually receive the income support payments as a result of the case!
