Not allowed IBJSA -child benefit terminal date

Hi,

My client’s daughter aged 19 is not returning to college as failed to get a place on her chosen course.

Client notified CHB office and CTC office.

CTC ended as of 31/8/14 as no longer in education. However I understand that the child benefit continues to be paid until 30/11/14 as this is the terminal date.

Client’s daughter made a claim for IBJSA but claim refused as still classed as a child in relevant education (presumably because still getting child benefit until 30th November).

Therefore the only income my client has for her daughter who remains dependent on her is child benefit as cannot get CTC for her (tax credits office have verbally confirmed this as they do not follow the same rules as CHB) and her daughter cannot claim JSA in her own right until after the CHB extension period.

Am I missing something here or is it the case that there is no extra benefit for her until the child benefit ends?
