DLA HRM and Motability Cars, Hospital or ‘similar institution’

I know that the rules about Motability cars and hospital inpatients were changed by SI389/2013 to say that even if a person has a Motability car the HRM stops after 28 days in hospital or similar institution, although there are also some rules concerning dates and when the agreement runs out.

My client has a slightly different situation, he goes to a nursing home, fully funded by the NHS, for four days each week but remains at home for the other three days. A relative of his seems to have been told two things,

i) that all his DLA will stop after 28 days, even when he is at home.
and

ii) When the HRM has stopped the car will have to go back.

The first one is OK, it doesn’t appear to have any founding in fact that I can see and is in all honesty probably the relative not fully understanding what was said.

The second is a bit more problematic, does anyone know if he would come under the new rules in SI 389/2013 (or other new rules) and lose the funding for the car after 28 days, even if he does come home for three days each week?

I can’t seem to find anything that covers the situation above, I have rung Motability and (although they were very helpful , saying they did not think it would make any difference), they did not seem very sure about it so I thought I’d try here to see if anyone has come across this before.
