CPAG is looking for test cases

CPAG is looking for test cases that have the potential to improve the lives of families in poverty. This includes judicial review claims and appeals in the First-tier Tribunal, Upper Tribunal, Court of Appeal, Supreme Court and European Courts. In particular, we are looking for test cases on the following areas:
• Benefit cap introduced by the Welfare Reform Act 2012
• Late mandatory reconsiderations
• Tax credit overpayments
• Notional entitlement (tax credits)
• Benefit delays

If you know of a possible case, please complete the test case referral form attached.

By bringing test cases, CPAG aims to improve the interpretation of the law so it promotes the rights of claimants - in particular families with children. We want to secure fairness in the system and ensure that benefit provision is as widespread and generous as possible.

The individuals and families can stay anonymous, and would only need to give us information about their situation. We are happy to talk through what would be involved with families or advisers.
