Client went for ESA medical . Examined outside of normal examining area because of disability therefore no access to computer programme. Medical report done by hand. Included in appeal papers however due to handwriting and poor photocopying we are unable to read the report fully. Requested that HMCTS obtain a typed copy, request refused as it can be read ( honestly it can’t ). Is there any case law in this area we can use before/at Tribunal? Want to try and avoid going to Tribunal and seeking an adjournment and direction.

Update. At the Tribunal the medical report was ruled out as evidence as it couldn’t be read. Support Group awarded.
