Permitted work for someone on ESA

Does any one have any experience of getting someone into permitted work? We’ve tried the local DEA who only suggested a job club. Getting up to date and actual advice as to how we go about this is proving very hard. Any hints/tips/suggestions gratefully received

Well, the type of permitted work will depend on the person claiming. Is it a person on ESA? If so, are they in the main or assessment phase? If the main phase, which group are they in? There are different types of permitted work depending on the nature of the ESA award, all including various restrictions. I can’t advise on actually obtaining such work, but perhaps somebody else here can suggest something.

I don’t know if you have the CPAG handbook but it is set out clearly there from page 1042.

But if you don’t the main sort of permitted work is ‘permitted work higher limit’.  This can be any sort of work but the claimant must be working on average less than 16 hours per week, earning not more than £104 per week, and not do the work for more than 52 weeks. If any of these limits are broken then they cease to have limited capability for work.

Other types of permitted work include ‘permitted work lower limit’ - where you can earn up to £20 per week for as long as you want. Under ‘Supported permitted work’ you cannot earn more than £104 per week again for as long as you want but the work must be ‘supervised’ or ‘part of a treatment programme’ - you would probably need to check with the DWP if the sort of work qualified.

Although any work can qualify as permitted work, if the claimant comes up for another work capability assessment it is helpful if they can explain why they are able to do that work eg able to take breaks whenever, more time given than would be in a ‘normal’ job.
