Sch 9 water charges deductions

I am currently trying to challenge our benefits agency new policy of not stopping water deductions under ‘interests of the family’ rules when requested by the claimant.

The final letter of the letter states;

‘Third party deductions should not be stopped because the customer requests this. This is because the customer’s request does not constitute a relevant change of circumstances’.

Whilst most other paras in this letter has been prefixed with the relevant benefits legislation, the above para has no afixed legislation I can refer to. I can not find anything in the legislation that refers to water charges and ‘relevant change of circumstances’. Does anyone know if any such legislation exists.

The letter also make reference to ‘compliance with a social obligation’, does such a thing exist, or is the BA coming over all Daily Mailish.

The letter also defines a ‘family’ as including anyone over 70, disabled or long term sick, as i have always assumed a family would have to include children for BA purposes, i sthere any basis for this.

The letter also makes reference to ‘disconnection to fuel supply’, as you cannot be disconnected from your water supply since the 1999 water industries act, i am wondering if much of this letter has any basis in BA regs, hence this post. Not with standing that the BA has until recently always stopped deductions at a claimants request, for the last 10 years to my knowledge.
