Hi everyone. I don’t know what’s going on at the moment. I think maybe the long weekend has interfered with my ability to locate anything in CPAG. Does anyone know how they calculate the amount recovered for a Pension Credit overpayment from State Retirement Pension. My client receives no means tested benefit other than housing benefit and is having about £35 recovered per week from his SRP. I had it in my head that they could recover 1/3rd of the personal allowance but I don’t know where I got this from.

Please help its driving me mad. Thanks in advance.

I think page 1276 of welfare benefits and tax credits handbook 2013/14 might help. As I understand it unless they are recovering from one of the common means tested benefits then DWP will seek to recover 1/3 of the personal allowance - Reg 16(5A) Social Security (Payments on Account, Overpayments and Recovery) Regs 1988 No. 664.

But you can request it is reduced for all the normal reasons…....
