DWP not proceeding with MR

We have had several cases recently where we have submitted an MR request on the client’s behalf to the DWP within the time limit, they telephone the client to ask about their care/supervision needs, advise the client they think the original decision was correct, and refuse to proceed with the MR.  We suspect they are leading the clients into under-stating their needs in comparison to what they told us when we completed the claim form, and that they are persuading the clients to accept the original decision was correct and possibly to withdraw the MR request.  Without an MR decision the clients cannot go to appeal.  Is it not the case that once an MR request has been submitted the DWP must issue an MR decision?

Yes it is in theory Brian but as this long thread makes clear, has long been a problem with MR and continues to be unfortuunately.

If you have recent examples, you can send a SPEC form through to the policy team and they can follow up with DWP but we need evidence to be able to do this.

DWP make challenging a decision a three stage process!
