Carer’s premium in HB
My client was receiving CA until her partner passed away recently. I’ve just been looking at some HB calculations from before her partner passed away and the income used includes her wages and her CA (her partner’s DLA is listed but ignored).
Their applicable amount seems to only include the couple’s PA and the disability premium, £160.80 in total. Shouldn’t the applicable amount also include the Carer’s Premium if one of them is receiving CA?
I’ve also noticed that they weren’t claiming ESA. I will ask her why, but before that I just want to make sure that I’m calculating the amount of ESA they should have received correctly. I’m thinking that if they tried to claim ESA in the past but were incorrectly advised that they weren’t entitled, there might be grounds for backdating…
Before the partner passed away, their applicable amount for ESA would have been: £114.85 (couple’s PA) + £36.20 (SG) + £34.60 Carer premium + £15.75 (EDP) = £201.40 Does that seem correct? I can’t remember if the EDP is paid at couple rate if only one if the couple meets the criteria for it.
My client’s wages and CA would have reduced the ESA income considerably (assuming they weren’t entitled to CB-ESA), but there still would have been some entitlement left.
Any comments gratefully received. I think I might be missing something (possibly a brain).
EDP should be included at the couple rate.
But other than that I think you’re spot on (both re the ESA and re the CP in the HB calc)
Thanks. I need to speak to her about why they didn’t receive ESA, but it sounds like the carer’s premium was left out of HB in error.
