HB and disability premium after a death

My client had the disability premium included in her HB applicable amount due to her partner’s DLA claim, but he recently died. Is the DP withdrawn from the applicable amount from the beginning of the following week or is there some run-on?

Hi Geep - there’s no equivalent run-on rules of disability premiums like the 8 weeks for carers premium or disabled child premium you’re probably thinking of - so HB award should alter from the Monday following the death and calculations based on the claimant’s new circumstances. Can’t see any grounds to get a premium included after that based on a partner’s eligibility to disability benefits, for someone whose partner has died.

It could still be the case that DLA may continue in payment beyond the Monday after death, as the general rule for payability of long-term benefits is that payment continues until the first day of the following DLA benefit week (Wednesday?). Don’t think this extra payability will enable a DP for a further week though, as claimant won’t ‘have a partner’ as required by the HB Regs in Schedule 3(12).
