Sorry if this seems a silly question. I have a client who recieves Incapacity Benefit Of £158PW which is paid from Jersey, She gets Housing Benefit but there is no disability premium included in the applicable amount, her income from Jersey is just treated as 'income from abroad',surely as she has a letter that states it is IB she should get a disability premium, she has to send to Jersey sick notes every 13 weeks.Any ideas!!

There is an issue around whether benefits paid by other countries can be "qualifying benefits" for premiums. The general consensus seems to be that - for example - Portugal's "version" of incapacity benefit cannot be a disability premium qualifer because the regs simply do not specify it. Not sure about the Jersey case, since it is actually called "incapacity benefit" and Jersey is in the Common Travel Area.

In any case, your person may qualify for the disability premium simply through being "incapable of work" for 52 weeks, if she is submitting medical evidence.

Thanks for that. I'll contact the Housing Benefit Dept and raise the issue with them given that the lady has been on this benefit for a few years.
