Adult Dependent Addition pre 1995 case
Tue 02-Sep-08 04:04 PM

Client has been on Incap(IVB) since 1984. His wife currently earns about £58 per week. She is therefore under the £60.50 per week earnings limit under CURRENT rules, but it appears that she should fall under the more generous tapered rule. This year's Disability Rights handbook sends you to the 26th Edition which gives the taper at 50% from earnings over £45.09 to £49, then 100% from £49 - £81.50. The decision makers guide doesn't help - does anyone know if this taper still starts at £45.09, or has it gone up and if so to what? Logically it should be £60.50 but when has logic and DWP gone together? Thanks.

The only answer of any sort I have gleaned so far from the DWP is that the taper has never been increased from £45.09. Thankfully there aren't too many of these cases about.

Hello Julie

Aren't you lucky. This limit has not changed since 95 for these cases. For the taper rule to apply she must have been working before 16.09.85 and not had a break of more than 8 weeks. You don't say when she started work.
Hope this helps.
M
