Claiming ESA instead of IS
Thu 20-Nov-08 11:29 AM

The introduction of ESA effectively removed certain categories of people who could claim IS from Schedule 1B of the IS General regs. Is there a simple list of these revocations anywhere, e.g. in an ESA reg? Some are not straightforward, e.g. disabled worker working under 16 hours.

Its in the transitional provisions regs:

reg 1(4) In these Regulations “income support on the grounds of disability” means income support awarded to a person to whom regulation 6(4)(a) or 13(2)(b) or (bb) of, or paragraph 7(a) or (b), 10, 12 or 13 of Schedule 1B to, the Income Support (General) Regulations 1987(2) (prescribed categories of person) applies.
