ESA Descriptors

Good morning, I'm not sure if I have read it wrong but I would appreciate a second opinion please. Whilst perusing the new descriptors for ESA (as you do) I happened to notice that in the mental, cognitive and intellectual assessment part at descriptor no. 16 - Initiating and sustaining personal action, descriptor (b) 15 pts and (c) 9 pts are exactly the same! Have I missed something? Is someone not telling me something? Have I read it wrong? many thanks

I read exactly the same thing therefore consider the legislators are being effective as usual.

Hm - I think (b) is the one with the mistake in it (comparing with the firts draft that went out to consultation), and the words "for the majority of the time" should only appear in (c)

Yes, it is a drafting error that DWP are aware of. Reg 16(b) scores 15 points and should read as follows we have been told (my emphasis in change in bold), and deletion as noted above:

Cannot, due to cognitive impairment or a severe disorder of mood or behaviour, initiate or sustain personal action without requiring daily verbal prompting given by another person in the claimant's presence."

We understand that amending regs to tidy up these sort of errors will be published prior to ESA introduction but still unsure as to exactly when.

ETA, also note that reg 19(b) scores 9 points, score seems to have been omitted from Si 2008/794.
