I posted a query in May 2007 regarding the above. I had very helpful replies from; Claire Hodgson, jj, fkaGerry2, Ruth_T, Rob_Price. I used the arguments suggested & the appeal was successful. IB was fully backdated to March 2007. Many thanks to all.

excellent news val! : ) i'm curious that it went as far as the tribunal...did it go to appeal without the NI record being amended by HMRC??

The NI contribution decision didn't actually go to tribunal. Following the contribution decision the client failed the PCA. The DWP submission was for contributions only. Following the success of the appeal benefit was awarded and fully backdated. Whatever the decision was it was worth the effort. Thanks again Val.
