Adult dependent addition
Tue 10-Jun-08 09:09 AM

Have a client who has long term Incapacity benefit that began by transferring from old invalidity benefit in 1995. She also has adult dependant (husband) and a child dependant additions.

The child is about to leave school so clearly the child dependant addition wil stop.

I am puzzled on one issue however. I can see the general principle that the adult dependant should continue whist the period of incapacity continues but I have also seen reference that at some stage the adult dependant was only awarded where there was child.

My question is - Does the adult dependant addition continue after the child dependant addition ends?

If the adult dep is not a spouse/ civil partner there is a requirement that they are caring for the claimant's child. Might this be what you're thinking of ?

Have a gander at page 86 of the dis rights handbook - this explains the rules when someone's transfered from invalidity benefit.
