I have a guy - British citizen - who returned to UK & claimed DLA. Didn't satisfy 6 months rule at time so claim refused. During the 6 months he has now reached 65 and wants to reclaim DLA. I don't think he can, as he didn't satisfy the conditions of entitlement, ie 6 months residence, before his 65th birthday, so it will be AA instead unfortunately.
Someone please tell me I'm missing something & he can claim?!

It might be worth checking if the residence conditions can be challenged ie was he living in a country with reciprocal agreements with Britain so that staying there can count as residence in Britain?

I have a similar question about this, and have posted my question as well (about a British person returning from Greece but running into 6 months residence condition for carer's allowance).
