Going into care on a trial period

Hi this might be an obvious one. I have someone who is moving into a nursing home on a trial basis for 4 weeks, does she have to notify the HB office before she goes as she is allowed to be absent from her home for 13 weeks, or only if she intends to be away for more than 13 weeks?

Strictly speaking this is reportable change although, as you say, benefit should continue.

However, the claimant could argue that it's not reportable becuause he or she knows that the change does not affect entitlement.

I favour the former because it is for the LA to decide if a claimant can can take advantage of the temporary absence rules. There will be arguments for the opposite approach.

A general principle that is worth remembering is that if you/a claimant is any doubt whether/when a change should be reported or not, report it ASAP and seek advice if benefit changes.
