Pension Credit and sponsorship undertaking
Mon 20-Nov-06 12:08 PM

I have a client who PC ended as the Home Office notified Pension Service of a sponsorship of undertaking. The client original came to the UK in 1998, her son in law completed the SET(F) form 17/02/1999 and the Home Office certified this document on 21/08/02. The client applied for IS on 2/03/2003 and was awarded IS from 11/06/03. She subsequently also applied for a British Passport and this was issued on 28/11/05.
1)Firstly, when does sponsorship of undertaking starts, from the date
of application of when the Home Office stamps the SET(F)?

2)Secondly does the fact that she has been granted a British passport overrides that she has a sponsership of undertaking and is therefore has recourse to public fund?

Any advice would be appreciated.

1) undertaking has effect from date of entry to UK or date of signing, whichever is later. HO stamp is irrelevant so far as I can see. Therefore on your facts should cease to be PSIC on 17/2/04.
2) If she becomes a British citizen she must cease to be a PSIC since the definition of PSIC begins "a person who is not a national of an EEA State". Issue of passport is irrelevant, it's granting of citizenship that matters. Remember though that only full British citizenship will count, if she's a British Overseas Citizen or a BPP she's not a British Citizen.

Is this the case you phoned me about this morning?
