bit of an odd one this ...

... hmmmmmmm , where to begin, stroke of chin ! ?

right ...

have a cl. who entered a local rehab centre on 17/09/07, but is normally resident in surrey where he has a flat and the rent is being met by the local authority there on the basis that cl. absence is temporary.

however, on 23/02/08 cl. is due to move in to a shared (halfway) house run by the local rehab centre when he will be liable for rent and a service charge on this property as well as the one in surrey.

right, i appreciate that h.b will not be met on two homes but does anyone know if cl. local social services have a duty of care to cl. to fund his rehabilitation fees at halfway house, and thus enabling him to continue to receive h.b on his property in surrey ?

i would appreciate any feed back on this if anyone has any ideas, good or bad ...

Hi Pete

The LA in Kent have no duty toward him as he is not ordinarily resident there. The LA in Surrey have no obligation to fund his rehab centre costs unless it places him there.

So, it is the LA in Surrey that has a duty to him and it is to it that he must apply for assessment of need. That does not automatically mean that the services of the rehab centre in Kent will be assessed as needed and if there is an assessed need at all, more local based services may be offered, and not necessarily residential either.
