Dual HB

Hi,

One of my clients has been in TA for almost 52 weeks. She has been getting dual HB because she has been a victim of DV.

She has given notice to the landlord of her old flat that she intends to leave by the end of December. HB has already paid up until the end of Dec.

My client wants to leave TA as soon as possible and is bidding for permanent accommodation with the council.

My question is: if she moves to permanent accommodation before the end of Dec, will she still be able to claim HB for her old flat until the end of Dec, or will she no longer be eligible for dual HB and thus liable for overpayment?

I don't think it's the date of the actual move that is going to be at issue. Dual HB in the circumstances you describe can be paid (under reg. 7(6) of the HB regs) where the claimant intends to return to their former home. She clearly didn't have such an intent from at least the date that notice was given and has, arguably, been overpaid since.
