Childcare disregard and ICB

Have a really unfair situation and would like some help.
Lone parent, twins aged 31/2, Gets childcare costs 270 quid with tax creds. Has a recurring illness which occasionally forces her to go on sick. Problem arises that when she does the IB long term rate is awarded so must be inside linking period. HB wont then disregard childcare costs because Reg28(2) doesnt cover that rate only short term icb. I'm arguing that Reg 28 (d) applies to allow the disregard and that refers to credits for incap (Reg 8B of Social Security redits regs 1975 (pg 382 CPAG Non MT benefits)

The client states this happens each time she goes on sick. She gets no benefit at all and her housing assoc. nearly evicted her last year.Wants to work and has to pay the childcare over to the nursery when sick to retain the places.

Grateful for any thoughts, especially if you've had same and resolved it
