IB Appeal - DWP have destroyed papers

In November 2006 my client had a medical for IB, having been on benefit for many years. He was notified in December 2006 he only had 13 points and IB was stopped. My client states he phoned to appeal, and sent a completed appeal form. DWP state they have no record of having received an appeal. My client has been to his GP many times to discuss this, and the GP has written to DWP to support his claim. DWP refused to accept an appeal therefore my client went to his MP who made enquiries. The MP was advised that all papers have been destroyed, and therefore my client should submit a fresh claim - which he did. Surprise, surprise - he cannot get IB now due to insufficient NI conts. The MP referred him to us for advice. I have made numerous enquiries, written to DWP and TS - we have finally been given written confirmation that the appeal has been accepted and can go through process. I await the bundle of paperes with anticipation - who knows what they will contain! However, if there really is nothing, where do we stand? Is it up to the DWP to prove that he did not qualify in December 2006 after having done so vor many years? I am, of course, seeking additional supportive medical evidence.
