New worker on PT contract/SSP
Mon 07-Jan-08 03:20 PM

Hello

I need someone to help me with my confusion, having got into a pickle with this problem.

Worker employed on a contract for 1 day per week but because of xmas ruch works many extra hours and pays NI. Becomes unfit for work after 6 weeks. Is he entitled to SSP?

I have become confused firstly because of the qualifying days. Since he is contracted to work on a Saturday only and would not normally work other days there is an argument for saying that this is the only qualifying day, yes?

Also, although on average he has earned more than £87 per week he has not been there long enough for an average over 8 weeks to be calculated and CPAG book doesn't give full details.

I should be very grateful for advice.

I would want to look at the contract. As well as outlining basic terms and conditions regarding duties and hours of work most contracts usually say something about performing extra duties as required, etc, etc. Then it would be worth getting an opinion from a contract lawyer.
