Good morning to everyone i hope someone can help.

I've got a client who has done 52 weeks work under the Permitted Work higher limit earning £30 per week on a self employed, freelance basis.

When the 52 weeks came to an end and in order that the work could continue, which was very theraputic, they informed Jobcentreplus that they were going to continue the work but were reducing their fee to £20 per week and so wished the work to be treated under the Permitted Work lower limit.

Jobcentreplus have decided that they had imposed an unreasonable reduction in earnings for the same work undertaken during the permitted work period and so are treating all of the work under the permitted work higher limit which means the client is treated as capable of work for a period.

I've checked all the regs within the decision maker's submission and can find nothing that alludes to the client reducing earnings and how this will affect the above scenario.

Could anyone point me in the direction of the correct regs please?

Have a look at reg 4 (notional income) of the computation of earnings regs (Bonner p 410). This would seem to be applicable to your client's case - from the departments view.
