query - if a person is in recipt of a police pension and Incapacity benefit, can they police authority deduct the value of the incap from their pension? I've not come across this before, and at first glance it doesn't appear equitable, in that you've paid for both....

I'd have thought that if that's what the rules of the occupational pension scheme say then they can do so.

The practical problem I see is the interaction between this rule and any reduction in your client's IB made under section 30DD of SS Contributions and Beneftis Act.

If the Police Authority deduct the full IB entitlement before paying the pension, DWP will then deduct 50% of the pension over £85.00, So surely the Police Authority should add this deduction back to the pension? But the DWP will then deduct 50% of this increase. So the Police Authority should.....
