HB being reinstated when Income Support is.
Wed 30-Apr-08 11:50 AM

Ok hopefully this is straight forward for someone - hopefully !

A person is on IS and getting HB. HB are informed that IS has ended and so suspend claim and write out to person for details of what income they are on. Person does not reply

3 weeks later IS is reinstated but person does not inform HB and so HB eventaully cancel claim.

Should IS have informed HB that claim reinstated and if so should HB have been reinstated or because HB wrote out to person for info and get no reply do they have right to cancel claim.

Person has now put in new claim for HB - 6 months later, can he request backdate based on fact been on IS all along ?

Cheers

some hopes! you know welfs hate being asked to give categorical yes/no answers on incomplete facts...too many ifs and buts in SS law. : )

why not request revision of disallowad claim based on revision of IS disallowance? reg 4(7C) HBCTB(D&A) Regs?
