LHA and relavant change of circs

I have 2 cases both in privatly rented accomodation but would not be treated under LHA as no break in award, however for one the partner has died, for the other the single person has started getting a regular inome from a trust matching his Income support therefore his Income Support is stopping. The Local authority state that with them being changes in circs they believe they will now come under LHA and not HB therefore one considerably worse off, the other slightly better off.

Should a change in circs when there is no break in time of an award simply the criteria for which a person is eligable has changed i.e. a new PC claim, or means tested instead of passported via I.S. attribute a change as far as Hb or LHA? I do not think it does but the Local authority are not sure and awaiting test cases.
